Public notice of intention to make a payment
31 Public notice of intention to make a payment
(1) The chief executive must, before making any payment under section 30 (2) ,
give public notice of the chief executive’s intention to make the payment.
(2) The notice must— (a) state the following— (i) the chief executive
intends to make a payment out of a former trustee’s security;
(ii) the name
of the former trustee who gave the security to the chief executive;
(iii) a
claim against the security for financial loss suffered from the misapplication
of trust moneys by the former trustee must be made within 2 months after the
date the notice is published; and
(b) invite any person who suffers a
financial loss from the misapplication of trust moneys by the former trustee
to make a claim against the security for payment of the loss amount in the way
mentioned in section 32 .
(3) The notice must be published on the
department’s website.
