Applications for exemptions
159 Applications for exemptions
(1) An application for an exemption must— (a) be made to the chief executive
in writing; and
(b) be signed and dated by or for the applicant; and
(c)
state the applicant’s name and address; and
(d) state the name of the
person to whom, or the name or a description of the class of persons to which,
the application relates; and
(e) state the provisions of this regulation, and
of the ADG Code, to which the application relates; and
(f) state the
dangerous goods to which the application relates; and
(g) state why, in the
applicant’s opinion, compliance with the provisions mentioned in paragraph
(e) is not reasonably practicable; and
(h) state why, in the applicant’s
opinion, the exemption is not likely to involve a greater risk than the risk
involved in complying with the provisions mentioned in paragraph (e) ; and
(i) if the application relates to a rail vehicle, equipment, packaging or
other thing—describe the vehicle, equipment, packaging or thing; and
(j)
state the period for which the exemption is sought; and
(k) state the
geographical area within which the exemption is to have effect; and
(l) if a
fee is stated for the application under section 180 —be accompanied by the
stated fee.
(2) The chief executive may, by written notice given to the
applicant, ask the applicant to give to the chief executive the additional
information reasonably necessary to decide the application.
