8 Conditions for discharges of oil

(1) This section applies to a ship with a gross tonnage of 400 or more, other than a ship that is an oil tanker.

(2) A discharge of oil from the ship is exempt from the operation of the discharge offences if the following conditions are complied with—

(a) the ship is proceeding en route;

(b) the ship has in operation oil filtering equipment required under a Commonwealth shipping law;

(c) the oil content of the effluent discharged is not more than 15 parts in 1,000,000 parts.
