Deciding application
59 Deciding application
(1) The chief executive must consider an application for a safe movement
permit made under section 58 and decide— (a) to grant the permit; or
(b) to
refuse the application.
(2) If the chief executive decides to grant the safe
movement permit, the chief executive must also decide the conditions of the
permit that apply to a light vehicle being driven or parked on a road under
the authority of the permit.
(3) Without limiting subsection (2) , a
condition may require a person driving a light vehicle under the safe movement
permit to carry the permit, or a copy of the permit, to be produced for
immediate inspection if an authorised officer asks to see it.
(4) The chief
executive must make a decision under this section within 28 days after— (a)
the day the chief executive receives the application; or
(b) if the chief
executive gives the applicant a notice under section 107 asking for further
information to decide the application—the day the notice is given to the
applicant.
