(1) The person with management or control of an amusement device at a workplace, in addition to complying with the record-keeping requirements of section 237 , must ensure that—(a) details of the erection or storage of the amusement device (including the date of erection) are recorded in the log book for the amusement device on each occasion on which it is erected or stored; and(aa) the log book for the amusement device is kept in a way that complies with section 242A ; and(b) the log book and operating and maintenance manuals for the amusement device are kept with the amusement device.Penalty—Maximum penalty—(a) for an individual—12 1 / 2 penalty units; or(b) for a body corporate—60 penalty units.
(2) The person with management or control of an amusement device at a workplace must ensure that persons involved in the commissioning, installation, use, storage and testing, and the decommissioning, dismantling and disposal, of an amusement device are provided with—(a) the log book for the amusement device in which details concerning erection, storage, operation and maintenance of the amusement device are recorded; and(b) the operating and maintenance manuals for the amusement device.Penalty—Maximum penalty—(a) for an individual—12 1 / 2 penalty units; or(b) for a body corporate—60 penalty units.
(3) The person with management or control of an amusement device at a workplace must ensure that the log book for the device is available for inspection by a competent person carrying out a major inspection of the device under section 241A .Penalty—Maximum penalty—(a) for an individual—12 1 / 2 penalty units; or(b) for a body corporate—60 penalty units.
(3A) If the person with management or control of an amusement device at a workplace (the
"first person" ) relinquishes the management or control of the device to another person, the first person must—(a) make the log book for the device available to the person to whom the management or control of the device is relinquished; and(b) take all reasonable steps to ensure any identifying information about a person who operated the device is removed from the log book for the device.Examples of identifying information that must be removed from a log book—• a person’s photograph• a record of a person’s training or qualificationsPenalty—Maximum penalty—(a) for an individual—12 1 / 2 penalty units; or(b) for a body corporate—60 penalty units.
(4) Subsection (5) applies if—(a) an amusement device is to be operated at an event conducted by a person (the
"event organiser" ) other than the person with management or control of the device at a workplace; and(b) the event organiser asks the person with management or control of the device for information about the device.
(5) Before the device is operated at the event, the person with management or control of the amusement device must give the event organiser the following information—(a) details about the most recent annual inspection of the device carried out under section 241 ;(b) details about whether each person who will be operating the device at the event has completed the instruction and training under section 238 and is a competent person to operate the device.Penalty—Maximum penalty—(a) for an individual—12 1 / 2 penalty units; or(b) for a body corporate—60 penalty units.
(6) In this section—
"identifying information" means information that identifies a person, or from which a person can be reasonably identified, other than the person’s name or signature if that information is required to be recorded in a log book to verify that an activity has been completed.
