(1) Subject to subsection (5) , if a person conducting a business or undertaking at a workplace determines that work at the workplace is lead risk work, the person must give the regulator written notice within 7 days that the work is lead risk work.Penalty—Maximum penalty—36 penalty units.
(2) A notice under this section must state the kind of lead process being carried out that includes the lead risk work.
(3) The person must—(a) keep a copy of the notice given to the regulator while the lead risk work is carried out at the workplace; and(b) ensure that a copy of the notice is readily accessible to a worker who is likely to be exposed to lead, and the worker’s health and safety representative.Penalty—Maximum penalty—36 penalty units.
(4) Subsection (5) applies to an emergency service organisation in relation to work carried out by an emergency service worker who, at the direction of the emergency service organisation, is—(a) rescuing a person; or(b) providing first aid to a person.
(5) The emergency service organisation must give notice under subsection (1) as soon as practicable after determining that the work is lead risk work.
