Time in which major hazard facility licence must be applied for
549 Time in which major hazard facility licence must be applied for
(1)
Subject to this section, the operator of a determined major hazard facility
must apply for a major hazard facility licence within 24 months after the
determination of the facility.
(2) The regulator may extend the time in which
the operator of a determined major hazard facility must apply for a licence if
satisfied, on application by the operator, that there has not been sufficient
time to comply with part 9.3 . Note— The exemption from the requirement to
be licensed is conditional on an application for a licence being made within
the time stated by this section, see section 535 (3) and (5) .
