(1) The
"operator" of a major amusement park is the person conducting the business or undertaking of operating the park who has—(a) management or control of the park; and(b) the power to direct that the whole park be shut down.
(2) If more than 1 person is an operator of the park within the meaning of subsection (1) —(a) the persons may nominate 1 of them as the operator of the park; and(b) the nominated person must give the regulator written notice stating—(i) the person is the operator; and(ii) that the other persons consent to the nominated person being the operator.
(3) The nominated person is the operator of the park for this chapter.
(4) If more than 1 person is an operator of the park and the regulator has not been given notice under subsection (2) , each of the following persons is taken to be the operator of the park for this chapter—(a) each operator within the meaning of subsection (1) who is an individual;(b) for an operator within the meaning of subsection (1) that is a body corporate—each officer of the body corporate.
(5) Subsections (3) and (4) apply despite subsection (1) .
