(1) This section applies if, immediately before the commencement, a person holds under the repealed WHS regulation—(a) an earthmoving or particular crane work certificate; or(b) an exemption from holding an earthmoving or particular crane work certificate.
(2) This section also applies if—(a) before the commencement, a person has made an application—(i) under section 80 of the repealed WHS regulation for an earthmoving or particular crane work certificate; or(ii) under section 28 of the repealed WHS regulation for an exemption from holding an earthmoving or particular crane work certificate; or(iii) section 114 of the repealed WHS regulation to replace an earthmoving or particular crane work certificate under; and(b) immediately before the commencement, the application has not been decided.
(3) On the commencement—(a) the certificate or exemption is cancelled; and(b) the application is taken to be withdrawn.
(4) The chief executive must—(a) give notice of the withdrawal of the application to the person who made the application; and(b) refund any fee paid for the application.
