WORK HEALTH AND SAFETY REGULATION 2011 - REG 769
Existing major hazard facility
769 Existing major hazard facility
(1) This section applies to a facility
that immediately before the commencement is a major hazard facility under the
repealed DGSM Act.
(2) On the commencement, the facility is taken to be a
determined major hazard facility under this regulation.
(3) However,
subsection (4) applies if, as decided under this regulation, schedule 15
chemicals are not present or likely to be present at the facility in a
quantity that exceeds 10% of their threshold quantity.
(4) The facility is
taken not to be a determined major hazard facility under this regulation.
