AIRPORT ASSETS (RESTRUCTURING AND DISPOSAL) ACT 2008 No. 46 - SECT 55

55 Restriction on designation for community infrastructure

(1) Despite the Planning Act, chapter 2, part 6, only a Minister may, under that part, designate airport land for community infrastructure.

(2) Development under a designation by a Minister under the Planning Act, chapter 2, part 6 is exempt development to the extent the development would, other than for this section, be self-assessable development or assessable development under a land use plan.

(3) Subsection (2) does not limit the Planning Act, section 2.6.5.

(4) In this section--

community infrastructure means community infrastructure under the Planning Act, schedule 5.
