BODY CORPORATE AND COMMUNITY MANAGEMENT AND OTHER LEGISLATION AMENDMENT ACT 2011 No. 9 - SECT 4

(1) Section 46(7)—

omit, insert—

'(7) For the contribution schedule for a community titles scheme established after the commencement of this subsection, the respective lot entitlements must be consistent with either—

(a) the equality principle; or

(b) the relativity principle.

'(7A) For the interest schedule for a community titles scheme established after the commencement of this subsection, the respective lot entitlements must be consistent with the market value principle.'.

(2) Section 46(8), from 'In deciding' to 'subsection (7)'—

omit, insert—

'In deciding the contribution schedule lot entitlements for a community titles scheme under subsection (7)(a), or the interest schedule lot entitlements for a community titles scheme under subsection (8)'.

(3) Section 46(7A) to (9)—

renumber as section 46(8) to (10).
