EDUCATION (QUEENSLAND COLLEGE OF TEACHERS) ACT 2005 No. 47 - SECT 55

55 Committee's decision about continuation of suspension

(1) After considering any submissions made by the approved teacher within the stated time under section 54, the Teachers Disciplinary Committee must decide whether it is an exceptional case in which the best interests of children would not be harmed if the suspension of the teacher were ended.

(2) If the committee is satisfied it is an exceptional case, the committee must order the suspension be ended.

(3) The committee's decision must be made not later than 14 days after the earlier of the following to happen--

(a) the committee receives the approved teacher's submission under section 54;
(b) the stated time under section 54 ends.

(4) If the committee does not make a decision within the 14 day period under subsection (3), the committee is taken to have made an order ending the suspension.

(5) The committee must, as soon as practicable, give notice of its decision to the approved teacher.

(6) The notice must state each of the following--

(a) the committee's decision and the reasons for it;
(b) if the decision is that it is not an exceptional case--
(i) that the teacher may, within 28 days after the notice is given, appeal against the committee's decision to the District Court; and
(ii) how to appeal.
