HEALTH AND HOSPITALS NETWORK ACT 2011 No. 32 - SECT 98

Each of the following persons (a commissioning authority) may appoint persons to be members of an RCA team to conduct an RCA of a reportable event—

(a) if the event happens while a public sector health service is being provided by a network—the network chief executive;

(b) if the event happens while a public sector health service is being provided by the department—the chief executive;

(c) if the event happens while a health service is being provided by a private health facility—the individual who has the day-to-day management of the facility or the individual who has overall management responsibility for the facility.
