JUSTICE AND OTHER LEGISLATION AMENDMENT ACT 2008 No. 59 - SECT 59

59 Amendment of s 15 (Leave of absence of judges)

(1) Section 15(8), definition prescribed authority, paragraph (a)--

omit, insert--

'(a) the Governor in Council, if--
(i) the judge is the Chief Justice, the Chief Judge or the Chief Magistrate; and
(ii) the leave of absence is more than 1 month; or'.

(2) Section 15(8), definition prescribed authority--

insert--

'(d) the Minister, if--
(i) the judge is the Chief Justice, the Chief Judge or the Chief Magistrate; and
(ii) the leave of absence is 1 month or less.'.
