MINING AND OTHER LEGISLATION AMENDMENT ACT 2013 No. 10 - SECT 165
165 Amendment of s 38 (Right to terminate call for tenders)
Section 38—
insert—
'(4) However, subject to sections 40(4) and 845(5),
the Minister must refund any tender security given by the tenderer.'.
