Confidentiality of information
102 Confidentiality of information
(1) An administrator must not, directly or indirectly, disclose confidential
information, that has become known to the administrator in the course of
performing the administrator’s functions under this Act, to another person
unless the disclosure is permitted under subsection (2) or (3) .
Penalty— Maximum penalty—100 penalty units or 2 years imprisonment.
(2) An administrator is permitted to disclose confidential information, other
than information that the administrator knows is of a secret or sacred nature,
to another person— (a) under this Act; or
(b) if the disclosure is
otherwise required or permitted by law; or
(c) if the person to whom the
information relates consents to the disclosure; or
(d) if the disclosure is
in a form that does not identify the person to whom the information relates.
(3) The commissioner may disclose information that is contained in a
person’s criminal history if the disclosure is made in— (a) a notice of
intention; or
(b) a statement of reasons given under section 58 (2) (a) .
