MINERAL RESOURCES AND OTHER LEGISLATION AMENDMENT ACT 2005 No. 8 - SECT 61

61 Amendment of s 39 (Taking, interfering with and using water for geothermal exploration)

Section 39(1), from 'the water'--

omit, insert--

'the taking, interference or use--

(a) happens during--
(i) the carrying out of geothermal exploration in the area of the permit; or
(ii) the compliance with a requirement or condition mentioned in section 97(1); 9 and
(b) is reasonably unavoidable.'.
