Deciding no jurisdiction for tribunal proceedings

251 Deciding no jurisdiction for tribunal proceedings

(1) A tribunal may decide that the tribunal has no jurisdiction for tribunal proceedings, at any time before the proceedings are decided—
(a) on the tribunal’s initiative; or
(b) on the application of a party.
(2) If the tribunal decides that the tribunal has no jurisdiction, the tribunal must give a decision notice about the decision to all parties to the proceedings.
(3) Any period for starting proceedings in the P&E Court, for the matter that is the subject of the tribunal proceedings, starts again when the tribunal gives the decision notice to the party who started the proceedings.
(4) The decision notice must state the effect of subsection (3).
(5) If the tribunal decides to end the proceedings, the fee paid to start the proceedings is not refundable.
