Proceeding not to commence if compliance notice in effect
203 Proceeding not to commence if compliance notice in effect
(1) This section applies to a person given a compliance notice stating a
provision that it is an offence to contravene.
(2) The person can not be
prosecuted for the offence unless the person— (a) fails to comply with the
compliance notice; and
(b) does not have a reasonable excuse for the failure
to comply.
