PUBLIC HEALTH (MEDICINAL CANNABIS) ACT 2016 - SECT 49

49 Dispensing approval taken to be in force while renewal application considered

(1) This section applies if a renewal application for a dispensing approval is made before the approval expires.

(2) The approval is taken to continue in force from the day that, apart from this section, the approval would have expired.

(3) Subsection (2) applies until the application is—

(a) decided under section ; or

(b) taken to have been withdrawn under section .

(4) However, if the application is refused, or taken to be refused under section , the approval continues in force until the information notice for the refusal is given to the applicant.

(5) Subsection (2) does not apply if the approval is earlier suspended or cancelled under chapter 5, part 2.
