PUBLIC HEALTH (MEDICINAL CANNABIS) ACT 2016 - SECT 78
Show cause notice
(1) This section applies if— (a) the chief executive reasonably believes a
ground exists to take administrative action in relation to an approval; and
(b) the approval holder— (i) has been given a compliance notice about the
matter to which the ground relates and the holder has failed, without
reasonable excuse, to comply with the notice; or
(ii) has not been given, and
it is not intended to give the holder, a compliance notice about the matter to
which the ground relates.
(2) The chief executive must give the approval
holder a notice under this section (a
"show cause notice" ).
(3) The show cause notice must state the following—
(a) the administrative action (the
"proposed action" ) in relation to the approval the chief executive proposes
to take;
(b) the grounds for the proposed action;
(c) an outline of the
facts and circumstances forming the basis for the grounds;
(d) if the
proposed action is a suspension of the approval—the proposed suspension
period;
(e) if the proposed action is a variation of the approval—details
of the variation;
(f) if the proposed action is the imposition of
conditions—details of the conditions;
(g) an invitation to the approval
holder to show within a stated period (the
"show cause period" ) why the proposed action should not be taken.
(4) The
show cause period must be a period ending not less than 21 days after the
show cause notice is given to the approval holder.
