(1) This section applies if a public sector entity is the subject of a public sector review.
(2) Before asking a reviewing entity to conduct the public sector review, the referring entity for the review must—(a) consult with, and have regard to the views of, the chief executive of the public sector entity about the proposed terms of reference for the review; and(b) inform the Minister administering the public sector entity, and the chief executive of the public sector entity, about the review; and(c) give the chief executive of the public sector entity an opportunity to nominate a stated number of employees who are employed in the entity to take part in the review.
(3) Nothing in this section prevents—(a) the Minister asking a reviewing entity to conduct a public sector review about a public sector entity administered by the Minister; or(b) the council asking a reviewing entity to conduct a public sector review about a public sector entity for which a member of the council is the chief executive.
