PUBLIC SECTOR ACT 2022 - SECT 50
Meaning of relevant duty
(1) A particular duty to be performed in a public sector entity is a
"relevant duty" if the chief executive of the entity decides under the
suitability directive that because of the nature of the duty, it may be
necessary to have regard to the criminal history of a person engaged to
perform the duty to ensure the person is suitable to perform the duty.
(2)
However, the duty is not a relevant duty if the duty is likely to involve—
(a) child-related duties; or
(b) regulated employment.
