PUBLIC SECTOR ACT 2022 - SECT 64
Application of division
64 Application of division
(1) This division applies if— (a) the chief executive of a
public sector entity engages, proposes to engage, or has engaged, a person to
perform a prescribed duty in the entity; and
(b) the chief executive (working
with children) has issued a working with children authority to the person; and
(c) the chief executive (working with children) has advised the chief
executive of the public sector entity, under the Working with Children (Risk
Management and Screening) Act 2000 , section 235 or 293 , that a further
assessment of the person may be needed to decide whether the person should be
engaged to perform the prescribed duty.
(2) However, this section does not
apply if the chief executive of the public sector entity engages, proposes to
engage, or has engaged, the person to perform the prescribed duty only— (a)
under a contract for services; or
(b) on a voluntary basis; or
(c) if the
person is a student—under an arrangement to provide the person with
practical experience in the person’s field of study.
(3) In this section—
"chief executive (working with children)" means the chief executive of the
department in which the Working with Children (Risk Management and Screening)
Act 2000 is administered.
