Requirement to notify executive officers of particular matters
75 Requirement to notify executive officers of particular matters
(1) This section applies if— (a) a corporation applies for an operator
accreditation under part 2 , division 2 ; and
(b) before the application is
decided, a person who is an executive officer of the corporation is charged
with, or served with an infringement notice for, a notifiable offence for the
accreditation.
(2) This section also applies if a person, who is an executive
officer of a corporation that is the holder of an operator accreditation, is
charged with, or served with an infringement notice for, a notifiable offence
for the accreditation.
(3) The person must, as soon as practicable but no
later than 14 days after the day the person is charged or served with the
infringement notice, give each of the other executive officers of the
corporation notice of the charge or infringement notice. Penalty—
Maximum penalty—20 penalty units.
(4) Also, the person must, as soon as
practicable but no later than 14 days after the day the charge or infringement
notice is dealt with, give each of the other executive officers of the
corporation notice of the following matters— (a) for a charge—the outcome
of the charge;
(b) for an infringement notice—how the infringement notice
has been dealt with.
Penalty— Maximum penalty—20 penalty units.
(5) A person does not commit an offence against subsection (3) or (4) if—
(a) the person has a reasonable excuse; or
(b) before the end of the period
mentioned in the subsection, the person— (i) stops being an executive
officer of the corporation; and
(ii) gives the chief executive notice of the
day the person stopped being an executive officer of the corporation.
