(1) The Governor in Council may make regulations under this Act.
(2) Without limiting subsection (1), a regulation may make provision for any matter stated in schedule 3 or otherwise related to work health and safety.
(3) A regulation may—
(a) allow the regulator to provide exemptions from complying with any of the regulations on the terms and conditions (if any) prescribed or, if the regulations allow, on the terms and conditions (if any) determined by the regulator; or
(b) prescribe fees for doing any act or providing any service for the purposes of this Act; or
(c) prescribe a penalty for any contravention of the regulations not exceeding 300 penalty units.
(4) Subsection (1) applies as provided under, and subsections (2) and (3) do not limit, the Statutory Instruments Act 1992.
(5) For the Statutory Instruments Act 1992, to remove doubt it is declared that—
(a) a reference in section 24 and 25 of that Act to exceptions includes exemptions, and exceptions and exemptions given on terms or conditions (if any) prescribed; and
(b) a reference in 30B(1)(b) of that Act to waiving payment of a fee includes reducing or refunding the fee.
