insert--

'(4) Subsection (5) applies if there is an inconsistency between--

(a) a provision in a code of practice in chapter 3 (the relevant compulsory code); and

(b) a provision in a code of practice mentioned in schedule 1, part 2 that is similar to the relevant compulsory code.

'(5) The provision in the relevant compulsory code prevails to the extent of the inconsistency.'.
