191 Sharing facilities—Act, s 95
(1) This section has effect despite anything else in this chapter.
(2) The
body corporate may, in the name of the body corporate, and if authorised by a
special resolution of the body corporate, enter into an agreement with the
body corporate of another community titles scheme under which the owners or
occupiers of lots included in the scheme and lots included in the other scheme
may share the use and enjoyment of— (a) facilities forming part of the
common property of either scheme; or
(b) body corporate assets for either
scheme.
Example— The body corporate may enter into an agreement under
subsection (2) with the body corporate for another community titles scheme
under which the owners or occupiers of lots included in the scheme may use a
tennis court forming part of the common property for the other scheme.
