The Parliament of South Australia enacts as
follows:
This Act may be cited as the Births, Deaths and Marriages Registration
(Registration of Deaths) Amendment Act 2008.
This Act will come into operation 1 month after assent.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Births, Deaths and Marriages Registration
Act 1996
4—Amendment of
section 39—Registration
Section 39—after subsection (2) insert:
(3) For the purposes of this section (but without limiting subsection
(2)), a requirement to include particulars about any person to whom the deceased
person was married will be taken to include particulars about a person who was
living in a de facto relationship with the deceased person at the time of
death.
(4) In subsection (3)—
de facto relationship, in relation to a deceased person,
means the relationship between a man and a woman, who although not legally
married to each other, were living together on a genuine domestic basis as
husband and wife on the date of the person's death and—
(a) who—
(i) had so lived continuously for the period of 3 years immediately
preceding that date; or
(ii) had during the period of 4 years immediately preceding that date so
lived for periods aggregating not less than 3 years; or
(b) a child, of whom the man and the woman are the parents, has been born
(whether or not the child is still living at that date).
