1 Application of amendments
The Parliament of South Australia enacts as
follows:
This Act may be cited as the Environment Protection (Testing, Monitoring
and Auditing) Amendment Act 2009.
This Act will come into operation 3 months after the date of
assent.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Environment Protection
Act 1993
4—Amendment of
section 52—Conditions requiring tests, monitoring or
audits
(1) Section 52(1)—delete "Subject to this section, the Authority
may" and substitute:
The Authority must
(2) Section 52(3)—delete subsection (3) and substitute:
(3) An environmental audit and compliance programme must include
requirements relating to the making of reports to the Authority in relation to
the programme and any evaluation process undertaken as part of the
programme.
5—Amendment of
section 109—Public register
Section 109(3)—after paragraph (e) insert:
(ea) details of—
(i) the results of any tests or environmental monitoring; or
(ii) any reports relating to an environmental audit programme or an
evaluation process undertaken as part of such a programme,
required to be undertaken by the holder of an environmental authorisation
in accordance with conditions imposed under section 52;
Schedule
1—Transitional provision
The amendments to the Environment Protection Act 1993 effected
by this Act only apply in relation to environmental authorisations granted or
renewed after the commencement of this Act.
