112A Labelling of food containing genetically modified
products
The Parliament of South Australia enacts as
follows:
This Act may be cited as the Food (Labelling—Genetically Modified
Products) Amendment Act 2008.
This Act will come into operation 1 month after the day on which it is
assented to by the Governor.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Food Act 2001
After section 112 insert:
112A—Labelling of food containing genetically
modified products
(1) A person who sells food in a package or displays food for sale that
consists of or contains a genetically modified product must—
(a) ensure that a statement, clearly indicating that the food consists of
or contains a genetically modified product—
(i) if the food is packaged—is attached to the package; or
(ii) in any other case—is displayed prominently near the food;
and
(b) comply with any other requirements prescribed by the
regulations.
Maximum penalty:
(a) if the offender is a body corporate—$250 000;
(b) if the offender is a natural person—$50 000.
(2) In this section—
genetically modified product has the same meaning as GM
product in the Gene Technology Act 2001.
