The Parliament of South Australia enacts as
follows:
This Act may be cited as the First Home and Housing Construction Grants
(Budget 2013) Amendment Act 2013.
This Act will come into operation on 1 July 2013 (and if this Act
is not assented to until after that date, it will be taken to have come into
operation on that date).
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of First Home and Housing Construction Grants
Act 2000
4—Amendment
of section 18BAB—Housing construction grant
(1) Section 18BAB(1)(b)—delete "1 July 2013" and
substitute:
1 January 2014
(2) Section 18BAB(1)(d)(iii)(A)—delete
"31 December 2014" and substitute:
30 June 2015
Schedule 1—Transitional
provision
(a) a person is entitled to a housing construction grant under
section 18BAB of the First
Home and Housing Construction Grants Act 2000 as amended by this
Act in relation to an eligible transaction with a commencement date that is on
or after 1 July 2013; and
(b) the person has received a benefit constituted by an
ex gratia payment by the State in order to provide for a housing
construction grant under section 18BAB as amended by this Act for the
period between 1 July 2013 and the day on which this Act is assented
to by the Governor,
the amount of the relevant entitlement will be reduced by the amount of the
ex gratia payment (including so as to fully set off the amount of
the relevant entitlement).
(2) Terms used in
subclause (1) that
are defined in the First
Home and Housing Construction Grants Act 2000 have the same
respective meanings as in that Act.
