The Parliament of South Australia enacts as
follows:
This Act may be cited as the Lottery and Gaming (Betting on Losing)
Amendment Act 2006.
This Act will come into operation 6 months after the day on which it is
assented to by the Governor.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.

of Lottery and Gaming
Act 1936
4—Amendment of
section 4—Interpretation
Section 4—After the definition of bet or make a
bet insert:
betting exchange means a facility whereby persons' offers to
make bets are published with a view to attracting others to accept the bets,
whether through the use of the internet or other electronic means, but does not
include a facility operated by—
(a) the licensee within the meaning of Part 2 of the Authorised
Betting Operations Act 2000; or
(b) a person or body holding a licence under Part 3 of the
Authorised Betting Operations Act 2000.
After section 64 insert:
65—Certain betting through betting exchanges
prohibited
(1) A person who establishes or conducts a betting exchange must not
permit the making of a bet—
(a) on an event in which only 2 participants compete against each other;
or
(b) in which the person initiating the bet bets that a participant in an
event will achieve a certain result in the event other than winning the
event.
Maximum penalty: $100 000 or imprisonment for 1 year.
(2) A person must not make a bet through the use of a betting exchange
if—
(a) the bet is on an event in which only 2 participants compete
against each other; or
(b) the person is initiating the bet and betting that a participant in an
event will achieve a certain result in the event other than winning the
event.
Maximum penalty: $10 000.
(3) In this section—
participant includes a team of participants.
