The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Local Government (Burning of Olive Material) Amendment Act 2012.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Local Government Act 1999

3—Amendment of section 254—Power to make orders

Section 254(1), table—insert after item 3:


3A. Activities on land that may cause a nuisance or harm



To do or to refrain from doing the thing specified in the order in order to abate a nuisance or harm, or a risk of harm, to health or safety associated with burning olive pits or other green or undried olive material.

A person is or has been burning olive pits or other green or undried olive material on land (whether or not within a dwelling or other building on the land) so as to cause—

(a) a nuisance to occupants of neighbouring land; or

(b) harm, or a risk of harm, to the health or safety of occupants of neighbouring land.

The owner or occupier of the land.
