Parliamentary address
The Parliament of South Australia enacts as
follows:
This Act may be cited as the Magistrates (Removal from Office) Amendment
Act 2009.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Magistrates
Act 1983
3—Amendment of
section 11—Removal of magistrate from office on determination of Full
Court
(1) Section 11(8)(d)—delete paragraph (d) and substitute:
(d) the magistrate is guilty of disgraceful or improper conduct.
(2) Section 11—after subsection (8) insert:
(9) For the purposes of determining whether proper cause exists for
removing a magistrate from office, conduct occurring before or after the
commencement of this subsection may be taken into consideration.
After section 11 insert:
11A—Removal of magistrate from office on joint
Parliamentary address
The Governor may remove a magistrate from office on an address from both
Houses of Parliament praying for his or her removal.
