The Parliament of South Australia enacts
as follows:
This Act may be cited as the Motor Vehicles (Emergency Contact
Details) Amendment Act 2005.
This Act will come into operation on 1 January 2007 or on an
earlier date fixed by proclamation.
In this Act, a provision under a heading referring to the
amendment of a specified Act amends the Act so specified.
Part 2—Amendment of Motor Vehicles Act 1959
(1) Section
77A(1) and (2)—delete "issued or renewed after
the commencement of this section" wherever occurring
(2) Section 77A—after subsection (2) insert:
(3) A
licence or learner's permit must, if an applicant for the issue or renewal of
the licence or permit so requests, include the name
and telephone number of a person to contact in the event that the holder of the
licence or permit is involved in an accident or emergency (the contact
person).
(4) If
the holder of a licence that does not include the information referred to in
subsection (3) requests that such information be included on the licence,
the Registrar must amend the licence in accordance with the request without
payment of a fee.
(5) The
Registrar must, on application by the holder of a licence or learner's permit,
amend the licence or permit so as to vary the name or telephone number of the
contact person.
5—Amendment of section 136—Duty to notify change of name, address etc
Section 136—after
subsection (1) insert:
(1a) If the person specified on a licence or learner's permit as the person to contact in the event of the holder of the licence or permit being involved in an accident or emergency changes his or her name or telephone number, the holder of the licence or permit must, within 14 days of becoming aware of the change, give notice to the Registrar of the person's new name or telephone number.
