The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Motor Vehicles (Demerit Points for Disability Parking Area Offence) Amendment Act 2015.

2—Commencement

This Act will come into operation 3 months after assent.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Motor Vehicles Act 1959

4—Amendment of section 98AB—Interpretation

Section 98AB(2)—before the definition of expiate insert:

disability parking area offence means an offence against rule 203(1) of the Australian Road Rules;

5—Amendment of section 98B—Demerit points for offences in this State

(1) Section 98B(1)—after "regulations" first occurring insert:

(other than a disability parking area offence)

(2) Section 98B—after subsection (1) insert—

(1aa) If a person is convicted of or expiates a disability parking area offence, 1 demerit point is, subject to this section, incurred by the person in relation to that offence.

6—Amendment of section 98BC—Liability to disqualification

Section 98BC(2)—delete subsection (2) and substitute:

(2) If a person who holds an interstate learner's permit or interstate licence has incurred an aggregate of 12 or more demerit points in respect of disability parking area offences or offences of a kind prescribed by the regulations for the purposes of this subsection committed within a period of 3 years up to and including the most recent date on which the person committed such an offence in respect of which the person incurred demerit points, the person is liable to be disqualified under this Part from holding or obtaining a licence or learner's permit for the prescribed period.
