44A Prohibition of

The Parliament of South Australia enacts as
follows:
This Act may be cited as the National Parks and Wildlife (Mining in
Sanctuaries) Amendment Act 2007.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of National Parks and Wildlife
Act 1972
3—Amendment of
section 44—Establishment of sanctuaries
Section 44(2)—delete subsection (2) and substitute:
(2) The Governor may, by proclamation made in pursuance of a resolution
passed by both Houses of Parliament, revoke a declaration of land as a sanctuary
under subsection (1).
(2a) Notice of a motion for a resolution under subsection (2) must be
given at least 14 sitting days before the resolution is passed.
After section 44 insert:
44A—Prohibition of prospecting and mining in
sanctuaries
(1) Rights of entry, prospecting, exploration or mining cannot be acquired
or exercised pursuant to a mining Act in respect of land constituting a
sanctuary.
(2) Subsection (1) applies—
(a) to sanctuaries whether constituted before or after the commencement of
this section; and
(b) to the acquisition of rights after the commencement of this section;
and
(c) to the exercise of rights whether acquired before or after the
commencement of this section.
