The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Native Vegetation (Expansion of Cemeteries) Amendment Act 2005.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.


Part 2—Amendment of Native Vegetation Act 1991

3—Insertion of section 40C

After section 40B insert:

40C—Expansion of cemeteries

(1) This Act does not apply to the clearance of native vegetation in connection with the expansion of an existing cemetery.

(2) For the purposes of subsection (1), a cemetery is any place that is being lawfully used for the burial of human remains.
