The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Police (Prohibition on Performance Targets) Amendment Act 2009.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Police Act 1998

3—Amendment of section 37—Code of Conduct

Section 37—after subsection (2) insert:

(3) Without limiting subsection (2), the Code must provide that a member of S.A. Police must not fix (whether directly or indirectly) minimum targets in relation to—

(a) the detection of offences against the Road Traffic Act 1961 or the Australian Road Rules; or

(b) the number of expiation notices issued in respect of alleged offences against the Road Traffic Act 1961 or the Australian Road Rules,

by a member of S.A. Police or a class of members of S.A. Police.

(4) However, a failure of a member of S.A. Police to comply with subsection (3) does not affect the validity of an expiation notice or prosecution.
