The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Public Sector (Functions and Resources Audit) Amendment Act 2018.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Public Sector Act 2009

3—Insertion of section 80A

After section 80 insert:

80A—Functions and resources audit

(1) A Minister must conduct a review of—

(a) the functions undertaken by each administrative unit for which the Minister is responsible; and

(b) the resources necessary to properly carry out those functions,

in order to identify areas in which budget savings may be made or areas in which budget deficiencies exist.

(2) A review is to be undertaken as follows:

(a) the initial review is to be undertaken as soon as practicable after the commencement of this section;

(b) the next review is to be undertaken as soon as practicable after the fourth anniversary of the commencement of this section;

(c) the third review is to be undertaken as soon as practicable after the eighth anniversary of the commencement of this section;

(d) the fourth review is to be undertaken as soon as practicable after the twelfth anniversary of the commencement of this section,

and so on.

(3) A report on each review conducted under this section must be laid before both Houses of Parliament as follows:

(a) in respect of the initial review—within 6 months after the commencement of this section;

(b) in respect of each subsequent review—within 6 months after the conduct of the relevant review.

(4) If a report has been prepared by a Minister under this section, the Minister and the Chief Executive of the administrative unit to which the report relates must ensure that any budget reductions applied to the administrative unit are applied in accordance with the findings in the report.
