The Parliament of South Australia enacts as
follows:
This Act may be cited as the Passenger Transport (Driver Accreditation)
Amendment Act 2009.
This Act will come into operation on a day to be fixed by
proclamation.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Passenger Transport
Act 1994
4—Amendment of
section 28—Accreditation of drivers
Section 28—after subsection (3) insert:
(4) A person is not eligible to hold a taxi driver accreditation unless
the person holds an appropriate driver's licence.
(5) A person is not eligible to be granted a taxi driver accreditation
unless the person has held an appropriate driver's licence for the period of
12 months immediately preceding the date of application for the
accreditation.
(6) In this section—
appropriate driver's licence, in relation to a taxi driver
accreditation, means—
(a) a driver's licence in force under the Motor Vehicles
Act 1959 that—
(i) authorises the holder of the licence to drive a motor vehicle of a
class that, in the opinion of the Minister, is appropriate to the accreditation;
and
(ii) is an unconditional licence as defined in that Act; and
(iii) is not subject to any condition that, in the opinion of the
Minister, imposes an inappropriate restriction for the holder of a taxi driver
accreditation; or
(b) a licence in force under a law of another State or a Territory of the
Commonwealth that—
(i) authorises the holder of the licence to drive a motor vehicle of a
class that, in the opinion of the Minister, is appropriate to the accreditation;
and
(ii) is not subject to any condition that, in the opinion of the Minister,
imposes an inappropriate restriction for the holder of a taxi driver
accreditation;
taxi driver accreditation means an accreditation to drive
vehicles for the purposes of a taxi service.
