The Parliament of South Australia enacts as
follows:
This Act may be cited as the Roxby Downs (Indenture Ratification)
(Application of Acts) Amendment Act 2007.
This Act will come into operation 1 month after it is assented to by the
Governor.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Roxby Downs (Indenture Ratification)
Act 1982
4—Amendment of
section 7—Modification of State law
(1) Section 7(2)(a)(iii)—delete subparagraph (iii)
(2) Section 7(2)(a)(v)—delete subparagraph (v)
(3) Section 7(2)(a)(xii)—delete subparagraph (xii)
(4) Section 7—after subsection (5) insert:
(6) The preceding subsections, and clause 7 of the Indenture, do not apply
in relation to the following Acts:
(a) the Aboriginal Heritage Act 1979;
(b) the Aboriginal Heritage Act 1988;
(c) the Development Act 1993;
(d) the Environment Protection Act 1993;
(e) the Natural Resources Management Act 2004.
(7) Clause 28 of the Indenture ceases to apply on the commencement of this
subsection.
(8) In the case of any inconsistency between the provisions of any Act
specified in subsection (6) and of the Indenture, the provisions of the Act
will prevail to the extent of the inconsistency.
(9) Subsection (1), and clause 35 of the Indenture, do not apply in
relation to an application for access to a document under the Freedom of
Information Act 1991.
