4Amendment of section 162B—Safety helmets
for riders of motor bikes and bicycles
The Parliament of South Australia enacts as
follows:
This Act may be cited as the Road Traffic (Helmets for Motor Bike
Riders) Amendment Act 2016.
This Act will come into operation 1 month after the day on which it is
assented to by the Governor.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.

of Road Traffic
Act 1961
4—Amendment
of section 162B—Safety helmets for riders of motor bikes and
bicycles
Section 162B—after its present contents (now to be designated as
subsection (1)) insert:
(2) A safety helmet to which this subsection applies—
(a) will be taken to comply with any specifications or matters relating to
safety helmets for motor bike riders or passengers prescribed under
subsection (1); and
(b) will be taken to be an approved motor bike helmet for the purposes of
the
Australian
Road Rules
; and
(c) may be sold or offered for sale for use by motor bike riders or
passengers.
(3) Subsection (2) applies to a safety helmet that—
(a) complies with the standard ECE 22.05 as in force at the time of the
manufacture of the helmet in, or the importation of the helmet into, Australia,
as the case may be (or as in force at any later time); and
(b) is marked with an international approval mark in accordance with
ECE 22.05.
(4) In this section—
ECE 22.05 means the United Nations Economic Commission for
Europe (ECE) Regulation No. 22 "Uniform Provisions Concerning the
Approval of Protective Helmets and their Visors for Drivers and Passengers of
Motor Cycles and Mopeds", incorporating the 05 series of amendments to
that regulation, and any further amendments approved and published by the ECE,
or any later version of that standard.
