The Parliament of South Australia enacts as follows:


Short title

1. (1) This Act may be cited as the Road Traffic (Highway Speed Limit) Amendment Act 2002.

(2) The Road Traffic Act 1961 is referred to in this Act as "the principal Act".

Insertion of s. 81

2. The following section is inserted in Division 9 of Part 3 of the principal Act before section 82:

Speed limits for designated highways

81. (1) A person must not drive a vehicle at a greater speed than 130 kilometres per hour on a designated highway.

(2) The speed limit fixed by subsection (1) applies in relation to a designated highway to the exclusion of any speed limit otherwise fixed by or under an Act, other than—

(a)a speed limit fixed in relation to a heavy vehicle; or

(b)a speed limit fixed by or under the Motor Vehicles Act 1959 in relation to the holder of a learner's permit or provisional licence; or

(c)a speed limit of 90 kilometres per hour or less.

(3) The following roads or parts of roads are designated highways for the purposes of this section:

(a)Road Number 1000, the Stuart Highway, between Port Augusta and the Northern Territory;

(b)Road Number 2000, the Eyre Highway, between Port Augusta and the State of Western Australia;

(c)Road Number 3400, the Barrier Highway, between the town of Hallett and the State of New South Wales;

(d)Road Number 1100, the Hawker to Lyndhurst Road, between the towns of Hawker and Lyndhurst.

(4) In this section—

"heavy vehicle" means—

(a)a bus with a GVM (gross vehicle mass) over 5 tonnes; or

(b)any other vehicle with a GVM over 12 tonnes; or

(c)a combination consisting of a motor vehicle towing two or more trailers.

Transitional provision

3. Where, immediately prior to the commencement of this Act, a speed limit greater than 90 kilometres per hour was fixed for a designated highway or part of a designated highway (other than a limit fixed in relation to a heavy vehicle or by or under the Motor Vehicles Act 1959 in relation to the holder of learner's permit or provisional licence), that speed limit will on the commencement of this Act cease to be so fixed.
