The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Road Traffic (Highway Speed Limit) Amendment Act 2004.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.


Part 2—Amendment of Road Traffic Act 1961

3—Insertion of section 81

Before section 82 insert:

81—Speed limits for designated highways

(1) A person must not drive a vehicle at a greater speed than 130 kilometres per hour on a designated highway.

(2) The speed limit fixed by subsection (1) applies in relation to a designated highway to the exclusion of any speed limit otherwise fixed by or under an Act, other than—

(a) a speed limit fixed in relation to a heavy vehicle; or

(b) a speed limit fixed by or under the Motor Vehicles Act 1959 in relation to the holder of a learner's permit or provisional licence; or

(c) a speed limit of 90 kilometres per hour or less.

(3) The following roads or parts of roads are designated highways for the purposes of this section:

(a) Road Number 1000, the Stuart Highway, between Port Augusta and the Northern Territory;

(b) Road Number 2000, the Eyre Highway, between Port Augusta and the State of Western Australia;

(c) Road Number 3400, the Barrier Highway, between the town of Hallett and the State of New South Wales;

(d) Road Number 1100, the Hawker to Lyndhurst Road, between the towns of Hawker and Lyndhurst.

(4) In this section—

heavy vehicle means—

(a) a bus with a GVM (gross vehicle mass) over 5 tonnes; or

(b) any other vehicle with a GVM over 12 tonnes; or

(c) a combination consisting of a motor vehicle towing 2 or more trailers.


Schedule 1—Transitional provision

1—Transitional provision

Where, immediately prior to the commencement of this Act, a speed limit greater than 90 kilometres per hour was fixed for a designated highway or part of a designated highway (other than a limit fixed in relation to a heavy vehicle or by or under the Motor Vehicles Act 1959 in relation to the holder of a learner's permit or provisional licence), that speed limit will on the commencement of this Act cease to be so fixed.
