is the child, or another descendant, of the other; or

relationship between them is traced through, or to, a person who is or was an
adopted child.
(3) For the purposes of subsection (2)—
(a) the
relationship of parent and child between an adoptive parent and an adopted
child will be taken to continue even though the order by which the adoption was

so cohabited with that other person continuously for the period of 3 years
immediately preceding that date; or
(b) has
during the period of 4 years immediately preceding that date so cohabited with
that other person for periods aggregating not less than 3 years.
(2) A

which he or she and the other person are the parents, has been born (whether or

or not one or both of the persons in relation to whom the declaration is sought
are, or ever have been, domiciled in this State; or
(b) despite
the fact that one or both of them are dead.
(9) It
must not be inferred from the fact that the Court has declared that 2 persons
were de facto partners one of the other, on a certain date, that they were de
facto partners as at any prior or subsequent date.
(10) For
the purpose of determining whether a person was, on a certain date, the de
