The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Serious and Organised Crime (Control) (Miscellaneous) Amendment Act 2009.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Serious and Organised Crime (Control) Act 2008

3—Amendment of section 14—Control orders

Section 14(2)(a)(i)—after "has" insert:

, within the period of 2 years immediately preceding the application,

4—Amendment of section 35—Criminal associations

(1) Section 35(6)(a)—delete "close family members" and substitute:

close personal associates

(2) Section 35(6)—after paragraph (e) insert:

(ea) associations occurring in the course of gatherings of a religious or spiritual nature or gatherings of individuals who share membership of a group that is religious or spiritual in nature;

(eb) associations occurring in the course of voluntary work in the community;

(3) Section 35(11)(b)—delete close family member and substitute:

close personal associate

(4) Section 35(11)(b)—after subparagraph (iv) insert:

(v) 1 is an uncle or aunt of the other (whether by blood or by marriage); or

(vi) 1 is a first cousin of the other (whether by blood or by marriage); or

(vii) 1 is a boyfriend or girlfriend of the other (provided that a person will only be taken to be a boyfriend or girlfriend of another person for the purposes of this subparagraph if the relationship between the 2 people involves a degree of intimacy that extends beyond mere friendship).
