The Parliament of South Australia enacts as
follows:
This Act may be cited as the Serious and Organised Crime (Control)
(Close Personal Associates) Amendment Act 2009.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Serious and Organised Crime (Control)
Act 2008
3—Amendment of
section 35—Criminal associations
(1) Section 35(6)(a)—delete "close family members" and
substitute:
close personal associates
(2) Section 35(11)(b)—delete close family member and
substitute:
close personal associate
(3) Section 35(11)(b)—after subparagraph (iv) insert:
(v) 1 is an uncle or aunt of the other (whether by blood or by marriage);
or
(vi) 1 is a first cousin of the other (whether by blood or by marriage);
or
(vii) 1 is a boyfriend or girlfriend of the other (provided that a person
will only be taken to be a boyfriend or girlfriend of another person for the
purposes of this subparagraph if the relationship between the 2 people
involves a degree of intimacy that extends beyond mere friendship).
